Terms of Service
1. Introduction
These Terms of Service (“Terms”) govern the use of services provided by Golden Steward, LLC (“Golden Steward,” “we,” “us,” or “our”). By engaging our services, you agree to these Terms.
2. Definitions
Client: The person or legal representative engaging Golden Steward.
Care Recipient: The individual receiving visits/services.
Steward: A vetted, independent contractor engaged by Golden Steward to deliver non-medical services.
3) Scope of Services (Non-Medical)
Golden Steward provides non-medical concierge support for older adults, including (as applicable): companionship, personalized family-style visits, technology & AI assistance, home and vehicle check-ins, appointment coordination and accompaniment, visit summaries for families, emergency/hospital visit support, and transitional support (see section 11).
We are not a licensed healthcare provider and do not diagnose, treat, or provide medical, nursing, or legal services.
4) Scheduling & Visit Length
Typical visit length is approximately three (3) hours unless otherwise arranged. Schedules may be weekly, biweekly, monthly, or as needed, and can be adjusted by mutual agreement.
5) Payment & Invoicing
Rates are provided after consultation and confirmed in your Service Agreement. Invoices are due upon receipt unless otherwise stated in the Service Agreement. Golden Steward may suspend services for past-due balances and may assess late fees as set forth in the Service Agreement.
6) Cancellations & Rescheduling
Please provide at least 24 hours’ notice to cancel or reschedule a visit. Late cancellations may be subject to a fee as specified in the Service Agreement. We understand emergencies occur and will make reasonable efforts to accommodate changes.
7) Client Responsibilities
Clients (or their representatives) agree to:
Provide a safe, respectful environment for stewards;
Share accurate care preferences, emergency contacts, and relevant information;
Notify us promptly of changes to health status, home access, or key logistics;
Comply with these Terms and the Service Agreement.
8) Independent Contractor Status
Stewards are independent contractors, not employees or agents of Golden Steward. Golden Steward coordinates services and quality standards but does not control all aspects of steward performance. Nothing herein creates an employment, medical, fiduciary, or legal advisory relationship.
9) Hospital & Emergency Support
If requested and as available, a steward may visit a hospital/medical facility to offer non-medical companionship and family communication. Stewards do not make medical decisions, provide clinical care, or interfere with medical staff instructions.
10) Third-Party Vendors & Coordination
At a client’s request, Golden Steward may help coordinate third-party services (e.g., movers, donation centers, contractors, couriers). Such third parties are solely responsible for their work. Golden Steward is not responsible or liable for third-party acts, omissions, schedules, pricing, warranties, or results.
11) Transitional Support (Sensitive Services)
Upon a family’s request after a loved one’s passing, Golden Steward may assist with organizing belongings, coordinating donations, arranging shipment of keepsakes, and scheduling contractors to prepare a residence for its next stage. These are practical, non-medical, non-legal tasks carried out with sensitivity and discretion. We do not provide legal, estate, or medical services.
12) Privacy & Confidentiality
Golden Steward respects your privacy and uses personal information only as described in our Privacy Policy. We maintain appropriate safeguards and share information only as needed to deliver services or as required by law.
13) Disclaimers & Limitations of Liability
Services are supportive and non-medical. Golden Steward makes no guarantees of outcomes, health improvements, or safety beyond reasonable care within our scope. To the maximum extent permitted by law, Golden Steward, its owners, and stewards are not liable for indirect, incidental, special, or consequential damages, or for events outside our control (including medical incidents, accidents, third-party acts, or home conditions).
14) Indemnification
You agree to indemnify and hold Golden Steward harmless from claims, damages, liabilities, and expenses arising from (a) your breach of these Terms or the Service Agreement; (b) misinformation provided to us; or (c) third-party claims relating to conditions at the service location.
15) Term & Termination
Either party may terminate ongoing services with seven (7) days’ notice. Golden Steward may terminate or decline services immediately in cases of unsafe conditions, harassment, repeated non-payment, or other material breaches.
16) Dispute Resolution; Governing Law
These Terms are governed by the laws of the State of Florida. The parties will first attempt to resolve disputes through good-faith discussion and mediation. If unresolved, disputes will be submitted to binding arbitration in Broward County, Florida. Each party bears its own costs unless otherwise ordered.
17) Changes to Terms
We may update these Terms to reflect changes in services or applicable law. Material changes will be posted on our website and, when feasible, provided to current clients at least 15 days before taking effect.
18) Acknowledgment
By engaging Golden Steward’s services, you acknowledge that you have read, understood, and agree to these Terms and the accompanying Service Agreement.
